The organizer of the competition is Oldskull Europe GmbH (hereinafter “ Organizer ”).

Participation in online or Facebook/Instagram competitions and their implementation are subject to the following provisions.

If this is a Facebook/Instagram competition, the following applies: all information relating to this competition is provided exclusively by the organizer. Meta Platforms Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (" Facebook " or " Instagram ") has no connection whatsoever with this competition and does not sponsor, support, or organize this competition. Therefore, no legal claims whatsoever exist against Meta.

§ 1 Competition

(1) The participation period for the competition (hereinafter referred to as the "promotion period") can be found directly in the competition.

(2) If the competition mechanism differs from the mechanisms described in Section 4 paragraph 1 of these Terms and Conditions, this mechanism, including the possibility of participation, will be described directly in the competition participation window.
If participation via Facebook/Instagram is possible, participation in the competition will take place in accordance with the description in the competition participation window.

a) either by using a meta application (hereinafter referred to as the "Application") on Facebook/Instagram. This application, linked to Facebook/Instagram, can be installed free of charge on the participant's respective Facebook/Instagram profile. After activating the "Like" button, the participant can participate in the competition by answering the competition question;
b) or directly on the organizer’s Facebook/Instagram website. In such a case, the participant can take part in the competition by answering the competition question with a comment under the competition post on the Facebook page (www.facebook.com/oldskulleurope.com) or the Instagram page (https://www.instagram.com/oldskulleurope); b) posting pictures/posts; c) “liking” the post, etc. If the participant uploads pictures, videos or texts as part of a post and/or comment, the participant guarantees the organizer that they are the rightful owner of the rights required for this.

The recorded time determines the time of participation. Replies/posts/comments/likes not submitted within the promotion period will not be considered. Neither the organizer, Meta, nor the cooperation partners (as defined below) are responsible for any delays in submitting or transmitting the response and participant data.

(3) The prizes of the competition are provided by the organizer. The organizer is the promoter according to Section 657 of the German Civil Code (BGB) and is therefore solely responsible for all claims related to the prizes.

§ 2 Participants

(1) Unless otherwise stated, this competition is open to persons who have reached the age of 14. Persons under the age of 14 are excluded from participation. Prizes will not be distributed to persons whose participation is expressly excluded.

(2) Participation in the competition and the distribution of prizes are limited to participants with a registered address in the EU, Switzerland, Norway and the United Kingdom.

(3) The participant is solely responsible for the accuracy of the data provided for participation in the competition (including the relevant data in the participant's Facebook/Instagram account). All personal information must be true. Failure to do so may result in exclusion from the competition in accordance with Section 3 (4).

(4) Each participant may only participate in the competition once. Multiple entries are not permitted. The organizer reserves the right to exclude participants from the competition in the event of multiple entries in accordance with Section 3 (2).

§ 3 Exclusion from the competition

(1) Employees and relatives of Oldskull Europe GmbH and all subsidiaries / holdings as well as the participating providers and prize sponsors are excluded from participation.

(2) In the event of a breach of these terms and conditions of participation, the organiser reserves the right to exclude persons from the competition and not to distribute prizes or to subsequently revoke and reclaim them.

(3) Persons who use unauthorized aids or otherwise gain advantages through manipulation will also be excluded. In these cases, prizes may be subsequently revoked and reclaimed.

(4) Anyone who provides false information about themselves or participates in the competition multiple times will also be excluded.

§ 4 Implementation and processing of the competition

(1) During the promotional period, participants will be asked a competition question. Participants can choose from a set of predefined answers. All prizes will be presented on the competition page. The winner(s) will be randomly selected at the end of the promotional period from among all participants who correctly answered the competition question. In the event that fewer participants correctly guessed than there are prizes available, the remaining prizes will be raffled off among all competition participants, regardless of the answer given.
Any participation options, participation rules, prize draws, etc. that deviate from this competition mechanism will be explained to the participant directly on the competition entry form. In such cases, unless otherwise stated, these deviating rules apply exclusively.

(2) Winners will be notified by email after the competition has ended. The prize will then be handed over directly between the winner and the organizer in accordance with the following conditions regarding prize notification and prize forfeiture in Sections 4 and 5.

If the competition is held directly on Facebook/Instagram, the winners will be notified by the organizer via the respective winner's Facebook/Instagram profile after the competition has ended. Alternatively, the winners may also be announced via the organizer's Facebook/Instagram profile after the competition has ended.

Each winner must then respond to the event via a private message to the event's Facebook/Instagram page using their real name within four business days of receiving notification of their win on their Facebook/Instagram profile or the winner's announcement on the event's Facebook/Instagram profile. If a winner does not respond within this period, the prize will be forfeited.

(3) The item presented as a prize in the competition is not necessarily identical to the item won. Rather, differences may exist in terms of model, color, etc. The prize sponsor reserves the right to select an item of average quality and type as the prize.

(4) The non-cash prizes will be sent by the organizer or a third party commissioned by the organizer via a freight forwarder, parcel service, or post to the postal address provided by the winner. Delivery is free of charge within the Federal Republic of Germany. Any additional transport costs and customs duties are to be borne by the winner. The place of performance remains the registered office of the organizer, despite the organizer assuming the shipping costs. In the event that delivery is made via a freight forwarder, the freight forwarder will contact the winner to arrange a delivery date. Delivery usually takes place Monday to Friday between 8:00 a.m. and 6:00 p.m. The winner must also provide an alternative address in their immediate vicinity to which the prize can be delivered in their absence. If the freight forwarder cannot find anyone at either the winner's address or the alternative address, a message will be left. The winner must bear the costs of redelivery.

(5) If delivery of the prize is not possible or only possible under unreasonable circumstances, the winner will receive a replacement of equivalent value. The winner will also receive a replacement of equivalent value if the original prize is no longer available in the presented version (model change, seasonal goods, etc.).

(6) Cash payment of the prizes or any substitute prizes is not possible under any circumstances.

(7) The claim to the prize or prize substitute cannot, in principle, be assigned.

(8) Complaints relating to the conduct of the competition must be submitted in writing to the organizer within 14 days of becoming aware of the reason, stating the competition. Complaints submitted by telephone or late will not be processed. Inquiries, complaints, and claims relating to prizes must be addressed exclusively to the organizer.

§ 5 Forfeiture of the prize

Unless otherwise stipulated in these Terms and Conditions, the winner is obligated to respond within four (4) weeks of the notification being sent. Otherwise, the right to the prize expires. Unless otherwise stipulated in these Terms and Conditions, a new winner will be selected by drawing lots. The right to the prize also expires if the prize cannot be delivered within four (4) weeks of the initial notification of the prize for reasons attributable to the winner.

§ 6 Early termination of the competition

The organizer reserves the right to cancel or terminate the competition at any time without prior notice and without stating reasons. The organizer will exercise this option in particular if, for technical reasons (e.g., viruses in the computer system, tampering with, or errors in the hardware and/or software) or for legal reasons, the proper conduct of the competition cannot be guaranteed. If such termination is caused by the conduct of a participant, the organizer may demand compensation for any resulting damages from that person.

§ 7 Data Protection

(1) Unless the competition is held directly on Facebook/Instagram, participation in the competition requires registration for the respective competition using the competition entry form, providing various data (hereinafter also referred to as "registration data"). For Facebook/Instagram competitions, participation is possible via the participant's registered Facebook/Instagram account.

(2) There is no right to register for the competition or to participate in the competition.

(3) The organizer collects, processes, uses, and stores the participant's data provided during registration for the duration of the competition for the purpose of conducting and processing the competition and transmits it to the respective prize sponsor or the agency supporting the prize sponsor for the aforementioned purpose. Without the participant's express consent, the registration data will not be used for any other purposes by the organizer or third parties.

(4) All personal data of participants will be processed and used by the organizer in accordance with legal regulations. Further information can be found in the privacy policy.

§ 8 Revocation

The participant is free to request the deletion of his registration data at any time by sending an email to s.os@oldskulleurope.com and thus withdraw from participation.

§ 9 Liability

(1) The organizer shall be released from all obligations upon fulfillment or delivery of the prize, unless an earlier date is stipulated in these regulations.

(2) The organizer is only liable for damages if the damage is due to intent or gross negligence. The organizer is liable for culpable injury to the life, limb, or health of a natural person even in cases of simple negligence. Furthermore, the organizer is also liable for the simple negligent breach of a cardinal obligation. Cardinal obligations are those whose fulfillment is essential for the proper conduct of the competition and the achievement of the contractual purpose, and on whose compliance a competition participant may regularly rely. The above limitation of liability applies in particular to damages resulting from errors, delays, or interruptions in the transmission of data, malfunctions of technical systems or services, incorrect content, loss or deletion of data, viruses, or in any other way related to the use of the application. Liability under the Product Liability Act remains unaffected.

§ 10 Miscellaneous

(1) Legal recourse is excluded.

(2) The law of the Federal Republic of Germany shall apply exclusively.

(3) Should any of these provisions be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.

(4) These conditions of participation may be changed by the organizer at any time without separate notification.
